Notice to All Customers — Bareboat Charter Agreement

  • By booking with us, you hereby agree to all terms and conditions herein and in the Bareboat Charter Agreement.


  • This notice is provided to help you understand key terms that apply to all bareboat charters. By booking and/or signing our Bareboat Charter Agreement, you acknowledge and agree to the terms and conditions below.


1) Hold harmless / indemnity (renter responsibility)

  • The Charterer agrees to indemnify, defend, and hold harmless the Owner (including the Owner’s agents, operators, and employees) from any and all claims, liabilities, damages, costs, or expenses (including attorneys’ fees) arising from the Charterer’s operation, use, or possession of the vessel.

2) Assumption of risk

  • The Charterer acknowledges that boating carries inherent risks, including personal injury, death, or property damage, and voluntarily assumes all such risks on behalf of themselves and their guests.

3) Slide-equipped boats (important safety notice)

  • Some vessels may be equipped with slides. Use of any slide is at your own risk.
  • By booking and/or using a slide-equipped vessel, you acknowledge and agree that: - The Charterer assumes full responsibility for the safe use of the slide by all members of the Charterer’s party. - The Charterer is responsible for supervising all guests, including children. - The Charterer accepts full responsibility for themselves and their party for any accidents, injuries, or damages that may occur during the charter.

4) Governing law & where disputes are handled

  • This Agreement is governed by the laws of the State of Florida. Any disputes must be resolved exclusively in state or federal courts located in Okaloosa County, Florida.

5) Entire agreement

  • The written Bareboat Charter Agreement is the complete agreement between the parties. Verbal statements or prior written materials not specifically included in the Agreement do not apply.

6) Charterer obligations

  • During the charter, the Charterer agrees to: - Not sub-charter or assign the Agreement without the Owner’s written consent - Not create any liens or encumbrances on the vessel - Keep a copy of the Agreement aboard the vessel at all times during the charter - Promptly correct any default if notified; the Owner may terminate the Agreement for default and require immediate return of the vessel


7) Delivery, cancellation, and refunds

  • Failure to deliver vessel: The Owner is not responsible for failure to deliver the vessel due to events beyond the Owner’s control.
  • Cancellation if delayed: The Charterer may cancel if delivery is not made within 24 hours.
  • Deposits: Deposits are non-refundable unless the charter is canceled due to unsafe conditions.
  • Weather cancellations: If canceled due to weather (at the discretion of the Owner or Skipper), a rescheduled trip will be provided within one year.


8) Arrival & late policy

  • If you arrive late, time will not be extended unless agreed upon by your hired Skipper.


9) Skipper rates (if applicable)

  • Skipper rates are listed in the Agreement and may be billed at $50 per hour (see your Agreement for the selected skipper and details). Operator must be selected and paid by charterer.


10) Insurance & responsibility for damages

  • The Owner maintains insurance coverage on the vessel.
  • The Charterer is responsible for any deductible, damages, or uninsured losses arising from the Charterer’s negligence or breach of the Agreement.
  • A copy or summary of insurance terms can be provided upon request.


11) Optional renters insurance acknowledgement

  • The Agreement includes an acknowledgement where the Charterer may choose to purchase optional liability insurance offered by the charter operator or decline it and assume full responsibility for the vessel and its use during the rental period.


12) Boat rules & safety warnings

  • For everyone’s safety, the Agreement includes rules and warnings, including: - Adult supervision required for children - Kids 6 years or younger must wear a lifejacket at all times - Prohibited activities: No diving, jumping, or illegal activities - Follow the Skipper’s instructions at all times - Prohibited items: No weapons, drugs, or glass onboard


Important Note

  • This notice is a convenience summary for customers and does not replace the full Bareboat Charter Agreement. If there is any conflict between this notice and the signed Agreement, the signed Agreement controls.

Return and refund policy


Crab Island Boat Co. – Refund & Cancellation Policy

At Crab Island Boat Co., we understand that plans can change. Please review our refund and cancellation policy carefully before booking.

Weather & Safety Cancellations

  • Safety is our top priority. If Crab Island Boat Co. cancels your trip due to unsafe weather, mechanical issues, or other conditions beyond our control, you will receive a full refund or the option to reschedule at no additional cost.
  • Light rain or overcast conditions do not automatically qualify for a cancellation. The captain’s decision is final.

Customer Cancellations

  • 48 hours or more before your scheduled departure:
    Full refund (minus any non-refundable processing fees, if applicable).
  • 24–48 hours before departure:
    50% refund.
  • Less than 24 hours before departure or no-shows:
    No refund.

Late Arrivals

  • Late arrivals may result in a shortened trip or cancellation without refund, as departures are scheduled to accommodate multiple bookings.

Early Returns

  • No refunds are issued for trips that end early due to personal preference, seasickness, or failure to follow captain or crew instructions.

Holidays & Peak Dates

  • Bookings on holidays or special event dates (e.g., Spring Break, July 4th, Memorial Day) may be non-refundable. These will be clearly marked at the time of booking.

Refund Processing

  • Approved refunds will be issued to the original form of payment within [5–10] business days, depending on your bank or card provider.

Alcohol & Conduct Policy

  • No refunds will be issued if a trip is terminated early due to unsafe behavior, excessive intoxication, or violation of local laws or company rules.

Agreement to Policy

  • By booking with Crab Island Boat Co., you acknowledge and agree to this refund and cancellation policy.
